1.) Scope
The following terms and conditions apply to the use of our services and orders.
2.) Registration and Account Use
2.1. Using our services does not necessarily require creating an account with us. However, you have the option to register, for instance, to use GPT-4. Registration is free.
2.2. You are responsible for all activities that occur under your account and commit to keeping your password secure and not sharing it with third parties. If you notice any unauthorized use of your account, you must inform us immediately.
3.) Contractual Partner, Contract Conclusion
3.1. The purchase agreement is made with (GULL AG – Käferholzstrasse 261 – 8046 Zurich – info@gull.ch).
3.2. By offering token packages on our website, we make a binding offer to conclude a contract for these products. The contract is finalized when you click the PayPal button to purchase a token package and confirm the purchase on the PayPal page. By confirming the purchase on the PayPal page, you accept the offer.
3.3. Please note that the final agreement of the contract also requires successful completion of the payment by the payment method you use (in this case, PayPal). If the payment fails for any reason, the contract is considered not concluded.
4.) Contract Language, Contract Text Storage
4.1. The language available for the conclusion of the contract is German.
4.2. We store the contract text and provide you with the details of your token purchases. You can view these on our platform under the “Buy Tokens” menu item, where details of each purchase, including the number of tokens, the amount paid, the payment ID, the status, and the date of purchase, are listed.
5.) Digital Products
5.1. Our products are exclusively digital tokens that can be used to access the GPT-4 model on our platform. After successful payment, the corresponding tokens are credited to your account in real time.
6.) Terms of Use
6.1. Purchased tokens may only be used for the purpose stated on our platform. Transferring or selling tokens to third parties is prohibited.
7.) Expiry of Tokens and Accounts, as well as Account Deletion
7.1. To ensure effective management and maintenance of our platform, we reserve the right to delete unused accounts and unused tokens after a period of inactivity of at least one year. Tokens lose their value upon deletion.
7.2. This ensures the efficient use of our resources and ensures that users cannot request a refund of their unused tokens after a significant period of inactivity. We recommend that you regularly log into your account and use your tokens.
7.3. You have the right to independently delete your account at any time. Please note that by deleting your account, all stored data and purchased tokens are permanently deleted.
7.4. We reserve the right to delete your account and terminate your use of our services if you violate these terms and conditions or if we detect misuse or illegal use of your account.
8.) Changes and Termination of Services
8.1. We reserve the right to modify or discontinue our services at any time, including but not limited to cases where our collaboration with OpenAI or another service provider ends or due to circumstances beyond our control.
8.2. In the event of a significant change or termination of our services, we will strive to inform you in advance and take all necessary steps to minimize the impact on you. Depending on the circumstances, this may include refunding all or part of the remaining token balances.
8.3. However, we do not guarantee or assume any liability for any changes, failures, interruptions, or termination of our services, and we cannot guarantee that we will be able to provide refunds or other forms of compensation in such cases.
8.4. In the event of termination of services for reasons beyond our control, we will strive to repay the remaining token balances to the best of our knowledge and belief. However, a guarantee for a full refund cannot be given.
9.) Prices and Payment Terms
9.1. Prices for our products are stated in the product description and include VAT. Currently, payment can only be made via PayPal.
10.) Warranty and Guarantees
10.1. The warranty is provided in accordance with legal regulations.
11.) Changes to the General Terms and Conditions
11.1. We reserve the right to change these terms and conditions at any time without prior notice. Any changes will be published on our website. Continued use of our platform after such changes constitutes your consent to the revised terms. It is your responsibility to regularly check the T&Cs and stay informed about changes.
